Description
The address on the second floor of a 4-storey apartment building in the Istanbul district of Sancaktepe Atatürk, Dumanlar Sokak, was searched with the claim that it was a “cell house”. Although there was no collision during the robbery, Dilan Kortak died at the scene after the shooting.
Current legal situation
The application against Dilan Kortak to the Constitutional Court (AYM) has been published. In the motion by the lawyers of the Kortak family, Ömer Çakırgöz, it was decided that the procedural aspect of Kortak’s right to life was violated. With regard to the plaintiffs’ statement that Dilan Kortak had been killed “by execution without trial, although there was no conflict” there was also an autopsy report. In addition to one bullet fired at close range to the head, the other 25 bullets were fired from a distance. In the decision of the Office of the Prosecutor General that there was no room for prosecution in the incident, the security forces acted under legitimate defensive conditions, took their measures to prevent the attack on them and are therefore considered to be acting in self-defence.
